We reserve the right to limit the sale of our products to any person, geographic region, or jurisdiction. All product descriptions, pricing, and availability are subject to change without notice. We reserve the right to cancel or refuse any order at our discretion.

3. Pricing & Payment

All prices are listed in Australian Dollars (AUD) and are inclusive of applicable taxes unless otherwise stated. Payment must be made in full at the time of purchase. We accept payment via the methods available at checkout.

4. Shipping & Delivery

Shipping times and costs are displayed at checkout. Apex Clothing is not responsible for delays caused by third-party carriers or circumstances outside our control.

5. Returns & Refunds

All returns and refunds are handled in accordance with our Return & Refund Policy, which forms part of these terms.

6. Intellectual Property

All content on this website — including but not limited to the Apex Clothing name, logo, graphics, images, text, and product designs — is the intellectual property of Apex Clothing and is protected under applicable Australian copyright and trademark laws. To the fullest extent permitted by law, Apex Clothing shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products. Our liability is limited to the value of the order in question.

These Terms of Service are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

9. Australian Consumer Law 

Nothing in this policy limits your rights under Australian Consumer Law. If your item is faulty, damaged, incorrectly supplied, or not as described, you may be entitled to a repair, replacement, or refund depending on the issue.

10. Separate “change of mind” from “faulty item” returns

We do not offer refunds for change of mind, incorrect size selection, or accidental orders. However, if your item is faulty, damaged, incorrect, or not as described, please contact us and we will assess the issue in line with Australian Consumer Law.

11. Limited stock / launch drop

APEX products may be released in limited quantities. Placing an item in your cart does not reserve stock. Orders are only confirmed once payment has been completed and an order confirmation has been issued.

12. Cancellation/editing rules

Once an order has been placed, we cannot guarantee cancellations or changes. If you entered the wrong size, address, or details, contact us immediately. We will do our best to help before dispatch, but changes cannot be made once the order has been processed or shipped.

13. Incorrect address / returned parcel terms

Customers are responsible for entering the correct delivery address. If an order is returned to us due to an incorrect address, failed delivery, or non-collection, the customer may be required to pay a re-shipping fee.
